Wisconsin baby drinks two shots of vodka, father arrested for fighting

Vodka is bad for babies. A felony strangulation and suffocation charge is bad for fathers.

Call it one more reason to breastfeed, but a formula-mixing mishap had serious consequences for a young Wisconsin family.

A 20-year-old Kenosha mother was at home on Monday. Preparing to feed her baby, she grabbed a plastic water bottle she always uses to mix formula for her bundle of six-week-old joy. Later that night Mom, her two kids, and their father, Brian Smith, went to the grocery store. On their walk home, the baby started acting “funny,” according to a criminal complaint. Her eyes were squinty, her hands and toes red, and one of her legs was shaking.

Unbeknownst to the mother, Smith had emptied the water bottle and loaded it with vodka, intending to take it out with him, before she used it to mix the baby formula. The infant had downed about two shots in her spiked formula.

As they returned home around 7 p.m., the parents realized what had happened and started fighting. The father, who had been drinking, blamed the mother and began berating and threatening her as they got back to their apartment.

“Who the fuck do you think you’re talking to?” he allegedly told her when she said they should focus on helping the child. “I will smack you the fuck up around here.”

He later chucked a water bottle at her, striking her in the back of the head. Smith, 22, is also accused of choking the woman and pushing her against a wall.

The woman called Smith’s mother, who later showed up with his sister, but they were unable to calm him down. After deciding to take the baby to the hospital, Smith allegedly got physical with his sister, too. While leaving their apartment building, Smith shoved her up against a wall in the hallway and started choking her, although she was still able to breathe. When the baby’s mother tried to intervene, Smith shoved her to the ground, repeatedly calling all three of the women “bitch.” Hearing the commotion, neighbors came out to see what was happening.

Amid his violent meltdown, Smith was told he wouldn’t be getting keys to the car. The mad dad continued his choke-y rampage, grabbing the baby's mother by the throat again and pushing her against the stairs. The mother later told the cops a “good Samaritan” saw what Smith was doing and clocked him in the head.

When the Kenosha cops showed up, Smith was still freaking out. A crowd of 10 to 15 people had gathered in the parking lot and Smith was “screaming and swearing” as his mother and others tried to pull him away from the car. Seeing the first officer on the scene, a sweaty and shirtless Smith stared at her with “clenched fists and muscles flexed.”

“Don’t fucking touch me,” he said, according to the complaint.

The officer whipped out her Taser and ordered Smith to stand down. After a tussle, the cops eventually cuffed and stuffed him into the back of a squad car. According to court records, Smith has been charged with felony strangulation and suffocation, two counts of battery, disorderly conduct, and resisting an officer. Neither parent faces charges over the accidental baby boozing.

An ambulance took the baby to a Milwaukee-area hospital where she registered a .294 blood-alcohol level — more than three times Wisconsin’s legal driving limit. However, she is expected to recover.
