Michael Brodkorb and Amy Koch could spend a year in jail for extramarital boinking

Minnesota's adultery statute says that "when a married woman has sexual intercourse with a man other than her husband, whether married or not, both are guilty of adultery and may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $3,000, or both."

And look, we don't want to give you an unpleasant mental image to kick off your weekend, but extramarital sexual intercourse is exactly what former conservative blogger extraordinaire and Senate staffer Michael Brodkorb had with ex-Senate Majority Leader Amy Koch.

Does the illicit sexing mean that some hard time is on the horizon for both of them? MPR's Bob Collins tweeted yesterday that "a former lawmaker who will not be named writes to say Koch and Brodkorb could get a year in the slammer."

There's a catch, though -- the statute says that "no prosecution shall be commenced under this section except on complaint of the husband or wife." So are either Brodkorb's wife or Koch's husband feeling vindictive enough to formally complain about their spouses' extramarital boinking?

Well, Brodkorb's relationship with his wife was pretty rocky about a year ago. On June 5, 2011, the two had an argument that frightened her so much, she ended up calling the cops. Koch, for her part, wouldn't say whether she planned to stay married to her husband during a Star Tribune interview conducted a month after news of the scandal broke, but her wedding ring was conspicuously absent. For the most part, however, there has been no news about each of their respective marital lives in recent months.

Considering it's been more than six months since we first brought the Brodkorb-Koch affair to light, it'd be shocking if either of their spouses filed an adultery complaint at this point. But if nothing else, it's pretty crazy that a law calling for cheaters to spend a year in the slammer is still on the books here in the progressive Land of 10,000 Lakes, isn't it?
