And that was only one part of an all-day rampage where he railed at his wife for having gone to a bachelorette party, according to a criminal complaint filed in Rice County. Mathews was upset with his wife for getting so drunk she needed to be hospitalized for alcohol poisoning. He called his wife "vulgar, racial names" over the phone and later showed up at their house, where he slapped her on the back "with all his might," according to the complaint.
Later, he sexually assaulted her while she slept in a drunken stupor. She eventually kicked him out of the house and asked for a divorce, and when she followed him outside to get the keys to her van he allegedly backed his car into her, pinning her against the vehicle.[jump]
Mathews' wife told Faribault police that she'd put the kids to bed on September 11 in the living room and took an afternoon nap. She woke up briefly to find that that Mathews was having sex with her. Their three-year-old was sitting at the end of the bed.
While Matthews subjected his wife to allegedly unwanted sex and vulgar language, her son only said, "Mommy," according to the complaint.
The woman was still drunk and half-asleep so she told prosecutors she was "80 percent" sure it had happened. Police interviewed Mathews on September 14 about the incident. He admitted having sex with her then and said he "wasn't sure" if she was awake during the intercourse. He also "admitted that his son was sleeping in the same room," according to the criminal complaint.
Prosecutors seem to believe her story: they filed a criminal sexual conduct charge against Mathews, in addition to domestic assault charges and criminal operation of a vehicle charges for pinning her against the van with his car.
